In the judicial practice,the number of cases involving traffic accidents in Ride Sharing car is increasing continuously.In order to clarify the responsibility of the parties involved in such tort accidents,more detailed research is needed on the relevant legal issues in this field.In general cases of motor vehicle traffic infringement accidents,the parties involved in the identification of the subject of liability include motor vehicle drivers,passengers and third parties.In addition to investigating the liability of the direct infringer,as the infringement accidents involved are motor vehicle traffic accidents,it is necessary to explore the liability of insurance companies in the specific issue of ultimate liability.Comparing with the general research on legal liability of motor vehicle traffic infringement accidents,when exploring the legal liability of traffic infringement accidents under the model of ride sharing car,we add a related subject,the car-hailing platforms.Although car-hailing platforms are only the bridges between the driver and the passenger in this mode,the legal relationship between car-hailing platforms and the ride sharing drivers has been determined when doing academic analysis and judicial practice.What's more,due to the participation of car-hailing platform,the insurance relationship involved in motor vehicles is becoming more complicated,so there will be controversy in discussing the specific compensation issues of insurance liability.Firstly,the author defines the connotation of the network contract,and analyzes the legal relationship between driver,the passenger and car-hailing platform from different victims(ride sharing drivers,passengers and third parties).What's more,according to the perspective of the general type analysis of the network traffic accidents and the provisions of the Tort Liability Law and the Road Traffic Safety Law of the People's Republic of China,it could determine the specific principles of liability for each relationship subject involved in the aforementioned types of traffic tort incidents involving car-hailing ride sharing car.The last but not the least,after analyzing the types of traffic infringement accidents involving car-hailing ride sharing car,the types of special infringements that may occur are enumerated one by one and the relevant legal issues should be analyzed.
