In recent years,as a new mode of transportation,the ride-hailing service has occupied a large market and changed people's travel habits.On the other hand,there are frequent legal disputes concerning the ride-hailing insurance.In particular,the insurance claim is not smooth after a traffic accident dispute when a private car offering ride-hailing service,which makes the ride-hailing service risky.Based on the positive development prospects of the ride-hailing industry,it is necessary to design a Customer-to-Customer car insurance system that meets the commercial and non-commercial nature of the car.To this end,this paper will consider the establishment of the Customer-to-Customer ride-hailing insurance system from the perspective of law,and the specific research is as follows:The first part is to make definitions.First of all,to make a conceptual identification and difference for the Customer-to-Customer car and ride-hailing service platform,to clarify the scope and nature of the Customer-to-Customer car,to define the two modes of the ride-hailing service platform,and to lay the foundation for the following discussion.Secondly,to analyze insurance regulations according to several cities' provisions of ride-hailing service and to know about the current market of the ride-hailing insurance.The second part presents the real problems.Firstly,to point out the realistic difficulties because of lack of the Customer-to-Customer car insurance and to analyze the improper situation from the perspective of legislation,enforcement and judiciary.The third part refers to learning from other countries.Through the study of ride-hailing service regulations in London and California,some advantages are found.For example,both of the two cities set insurance access standards for drivers and platforms.California government even divides the duration of insurance into fourperiods,and requires platforms and drivers to take responsibilities.The fourth part puts forward the idea of ??the design of Customer-to-Customer car insurance products,and studies the establishment of Customer-to-Customer car insurance legal system.First of all,it is important to make sure the necessity of the Customer-to-Customer ride-hailing insurance.In the aspect of insurance product design,the insured and insurance period of Customer-to-Customer car insurance are studied.Secondly,the flexible application of UBI car insurance is proposed.The rise of the network car allows the insurance industry to try to develop new car insurance like UBI.In terms of perfecting insurance laws and regulations,first of all,it is necessary to analyze the multi-method relationship involved in Customer-to-Customer car operation.Secondly,it puts forward the insurer's clear obligation to explain and the risk increase notification obligation of the Customer-to-Customer car driver.Finally,it discusses the sharing of tort liability after the accident,proposes the no-fault liability of the network car platform and the fault liability of the Customer-to-Customer car driver,and balances the rights and obligations of the network car platform and the Customer-to-Customer driver.It also guarantees the victim's right to adequate compensation.
