Study On The Applicable Scope Of Civil And Commercial Online Dispute Resolution

At the end of last century,with the rise of Global trade and the early development of the Internet,Online Dispute Resolution(ODR)emerged as the times require from alternative dispute resolution(ADR).In just over ten years,it has followed the rise of e-commerce.From online ODR service website to ODR service software,from third party to fourth party,from non-litigation to litigation...The development of ODR can be said to have undergone tremendous changes in the times and science and technology.It is also true that nowadays ODR is mixed,and there are too few theories on ODR,and there are too many dispute resolution mechanisms that call themselves ODR.This article will take civil and commercial affairs as an example,starting from the history of ODR development,to find out the inevitable law of ODR development,to solve the three most basic "I" problems in ODR development-who I am,what I am doing,where I am going,that is,what is ODR,what it is to solve and where it will go in the future.Only by solving these three basic problems can we provide sufficient nutrients and malpractice emergency mechanism for the healthy development of ODR in the future,and improve the efficiency of judicial activities in China.
