On The Improvment Of The People’s Mediation System Applicable Scope

The people’s mediation system is in keeping with China’s national conditions, social conditions and public sentiment. It played an important role in resolving civil disputes, reducing the pressure on the court case and maintaining of social stability. In order to make people’s mediation system more operational and better able to play a dispute resolution, This thesis analyzes the shortcomings of current legislation does not clearly defined the specific scope of application of the system of people’s mediation, and pointes out that the legislative defects and problems in practice, and then puts forward some recommendations for improving the people’s mediation system applicable scope.This thesis is divided into two parts.The first part discusses the necessity of perfecting the people’s mediation system applicable scope. By analyzing deficiencies in the legislation and problems in practice, this thesis elaborates the necessity of improving the people’s mediation system applicable scope.The second part discusses the recommendation to improve the people’s mediation system applicable scope. Firstly, this thesis determines the principle of the people’s mediation system applicable scope, and then, puts forward the following disputes should also be included in the scope of application of the people’s mediation system:Disputes between the corporations and society organizations; Disputes involving civil rights and obligations but not yet included in the legal regulation; Disputes that caused by the life trivial and some minor criminal cases.
