Research On The Development Of The Rule Of Law Thought Of The Communist Party Of China After The Founding Of New China

The Chinese Communist Party's thoughts on rule of law,guided by the Marxist theory of law,and in combination with specific national situations,have been being succeeded and improved,and achieved by Chinesization of,the Marxist theory of law,establishing a soundly theoretical grounds for legal constructions of China.Mao Zedong,Deng Xiaoping,Jiang Zemin,Hu Jintao,and Xi Jinping had performed,one after another,Chinesization of the Marxist theory of law apiece,with integrating realistic national conditions in terms of historical background they were standing on,thus the Chinesization achievements constitute the main body of the Chinese Communist Party's thoughts on rule of law.Mao Zedong thoughts on rule of law were the onset of the Chinese Communist Party's thoughts on rule of law,wherein the creative theory of New-democratic Constitutionalism included settled the prime foundations for the formation and development of the coming thoughts of CCP(Chinese Communist Party)on rule of law.Deng Xiaoping formulated the legal constructions,by in-depth summary of the historical experiences in and beyond China,laying the significant basis for the construct of Rule of Law general principle.Jiang Zemin,following Deng,fomally outlined the Rule of Law general principle,which is a milestone across the historical pathway of legal progress in China.Hu jintao elaborately generalized the experiences from socialistic legal constructions based on socialist cause,proposing several ideas including “promote law-based administration,enrich socialistic legal spirit”,“foster socialistic ideas concerning rule of law” and “broaden orderly political participation of citizens”.Xi Jinping,stepping forward with the precedents' thoughts on rule of law,giving a number of important points encompassing “constitution-based ruling and governance”,“constrain power,promoting equality and justice” and “strengthen the abilities of cadres to implement Rule of Law thinking and approaches”.The CCP's thoughts on rule of law at different stages are coherent,collectively revealing the historical progress path of the CCP's thoughts on rule of law.In conclusion,the study shows there are positive impact,from experiences which are learned during development history of the CCP's thoughts on rule of law,on current legal constructions.
