Study On The Administrative Law Of Personal Information Protactive In The Era Of Big Date

The application and development of information technology and big data technology make the role of data more and more prominent.However,the following challenges are also very arduous,bringing new risks in data collection,data processing,data storage,data sharing and content security.Data governance and data security are particularly important in the current information development.In daily life,we often face such a situation,ubiquitous scam phone calls,product marketing calls,SMS bombing is boring.It triggers people to think,how can they know my phone? When and where did my information be leaked? In the age of the Internet,this kind of personal information at any time will be known to others panic in the threat of everyone,this destruction of "privacy" is a matter of great fear,as if by others peeping,surveillance.This makes us have to pay attention to the security of personal information.Personal information security is under serious threat.Personal information is at any time exposed to the risk of being compromised and used illegally in the context of big data.The protection of personal information has become a common concern,but at present,there is no special administrative laws and regulations in China to regulate this,which exacerbates the risk of infringement of personal information.Therefore,the governance of personal information is more urgent and realistic.This paper probes into the protection of personal information from the protection of administrative law of personal information,defines the related concepts of administrative law protection of personal information,probes into the new characteristics and contents of personal information protection in the era of big data,and analyzes the present situation and practical predicament of personal information protection in our country.To provide opinions and suggestions for the Administrative law protection of personal information in the era of big data.In this paper,the text is divided into four parts,the first part is the era of big data summary of administrative law to protect personal information,firstof all,big data and personal information,connotation to interpret the concept of administrative law protection,points out that the era of big data administrative law to protect personal information of the new content,pay more attention to the comprehensive protection of personal information property attribute,and then explains its right basis,to provide theoretical support for administrative law protection of personal information,the final account big data era of personal information protection,the necessity of administrative law.The second part is the status quo and reason analysis of personal information administrative law protection in the era of big data.First sorted out the current situation of the administrative law of personal information protection,found existing in the protection of personal information legislation,administrative supervision is weak and lack,administrative relief and difficult problems,and then analyzes reasons for the existence of these phenomena and points out that the digital world contributed to the administrative legislation,administrative supervision and the difficulty of the administrative remedy,establish the direction for information protection system.The third part is the big data investigation and experience for reference of the outside of personal information protection,focusing on the United States,the European Union,Japan's personal information protection legislation mode,legislation present situation,the legislation content and so on carries on the collection and analysis,points out that to establish and improve the system of administrative law protection of personal information in our country's experience for reference,the necessity of the unified legislation of personal information protection,give full play to the role of the industry self-discipline and processing and use of personal information for specification of the executive branch.The fourth part is the realization path of personal information administrative law protection in the era of big data.It elaborates from the aspects of promoting the special law of personal information protection,strengthening the improvement of administrative supervision system,improving citizens' awareness of rights protection and improving the administrative relief system.
