| From the perspective of civil law,the civil rights of citizens are violated by the slanderous network rumors continually in the "virtual world" by virtue of its characteristics in behavioral subjects,behavioral objects,distribution carriers,legal responsibilities and harmfulness.From the perspective of civil law system,there are still some shortcomings in Chinese relevant legal norms governing such rumors,such as the legislation is too general,the level of legislation is low,and some provisions of laws and regulations are not clear.In addition,the weakening of supervision in the Internet industry self-discipline,the difficulty in realizing the private relief procedure,and the deficiencies in the quantitative results of the damage result have led to the problem of "treating the symptoms and not treating the problem" for the regulation of the network rumors.In this regard,the author’s suggestion is improving the special legislation for regulating Internet rumors,increasing the "insinuation" and "behavior-based" methods,joininO the rules of mass shackles,raising the level of legislation,defining clearly the concept,the composition,introducing the principle of "public figures",encouraging industiy self-discipline,classifying and refining the responsibilities of network service providers,carefully implementing the network real-name system,and improving the quantitative standards of network/infringement damage results.Under the premise of guaranteeing the exercise of citizens’ freedom of speech,it is better to conduct civil laws and regulations fundamentally on cyber rumors. |
