| The characteristics of the network,open,free speech,which is the fertile ground for rumors.Internet rumor like a socially cancer,continued erosion the environment of network,also endanger the real-life individuals,companies organizations,social order.Furthermore,compared to traditional rumor,internet rumor has greater harm to social.So,we should have a clear understanding of network rumor,including its concept,internal and status quo.However,there are still many insufficient exist China’s current legal system in the regulatory network rumors.It proposed to improve the legal regulations of criminal prosecution and criminally relevant,eliminate network rumors survive legal loopholes.Therefore,the purpose of this paper is to address the relevant provisions of China’s Internet rumors in the relevant provisions of the relevant provisions of the status quo and defects,and proposed a comprehensive management of network rumors of the criminal law regulation of the restoration measures to effectively promote social harmony and stabilityIn this paper,the problem of criminal law regulation of Internet rumors has been in-deep analyzed by comparative analysis,induction analysis and value analysis etc.research means.Therefore,this paper is divided into four parts.The first part defines the concept and characteristics of network rumors.The second part analyzes the causes of the network rumors,the current situation and the harm.The third part is classified and analyzed the defects of the existing charges.The fourth part is the perfection of the criminal law of the network rumors.In this paper,the research value of the regulation of network rumors has theory and practice two different levels.From the level of theoretical value,this paper accurate and comprehensive exposited the basic type of network rumors theoretical issues,including network rumors concept,causes and current situation,also discussed the social harm by network rumors,and it is making an important theoretical basis for management decisions.From the level of practical value,the network rumors could seriously harm the social environment,seriously affecting social harmony and stability.Reasonable and properly management of network rumors,and to avoid network as "extrajudicial space" has become one of the major practical issues that must be addressed. |
