Criminal judgment documents are the final products of criminal litigation activities.The level of writing and the quality of documents directly represent the fairness and justice of criminal trial activities and directly bear the functions of adjudicating disputes,preventing crimes and punishing crimes.At present,there are some deficiencies and problems in the evidence reasoning of criminal judgment documents in our country,such as the lack of rationality in the use and expression of evidence,the general lack of response to the opinions of the defense,and the lack of the discussion on the formation of case facts and the final proof of heart.Therefore,in this paper,the author adopts the empirical research method to investigate and discuss the theoretical and practical problems of the evidence reasoning system of criminal judgment documents,so as to conceive the way to improve and perfect the evidence reasoning system of Chinese judgment documents.This paper is divided into five parts.The first part is the introduction,which makes a preliminary elaboration on the argumentation of criminal judgment document evidence discussed in this paper.The second part is the significance of the evidence reasoning of criminal judgment documents.In this part,the author introduces the value of criminal judgment documents to the trial substance,its realistic performance and its due standards.The third part is the empirical research and analysis of twelve samples of criminal judgment documents.The fourth part is based on the empirical research conclusion of the third part,analyzing and concluding the problems and deep reasons existing in the reasoning of criminal judgment documents.The fifth part is the path of sound criminal judgment document evidence reasoning which combines the foregoing elaboration and fully considers the judicial practice reality.
