Research On Lawyers' Participation In The System Of Confession And Leniency

The system of admitting guilt,recognizing punishment and being lenient is an important system in China's criminal justice reform.Its smooth operation cannot be achieved without the effective participation of lawyers.However,at present,our country is still lack of lawyers involved in the system of complete mechanism.This article will start with the necessity of lawyers' participation in the system of confession and leniency,based on the current situation of lawyers' participation in the system,and combining the design of similar systems abroad with the actual needs of our country,to put forward suggestions for improving the construction of lawyers' participation mechanism in the system of confession and leniency.This article is divided into the following four parts:The first part,the author will discuss the necessity of lawyers' participation in the system of confession and leniency in reasonable and realistic aspects,and explain the reasons why lawyers participate in the system of confession and leniency.The second part,the author will take the practice of lawyers' participation in cases of guilty plea and lenient punishment as an example.Then the author analyze the achievements and existing problems of lawyers' participation in the system.The third part,the author will analyze and compare the extraterritorial lawyer's participation mechanism in the similar system of confession,punishment and leniency·The fourth part,on the basis of referring to relevant overseas experience and combining with the needs of our country,how to improve the path construction of lawyers'participation in the system of confession,recognition and punishment,and strengthens the breadth and depth of lawyers' participation in the system of confession,recognition and punishment.
