On Consumers' Right To Know And The Obligation Of Business Operators

Due to the profitability of operators and the complexity of products brought about by technological development,the difficulty of realizing consumers' right to know is increasing.Reasonable penalties for infringing on the weight of consumers' right to know about the operator's failure to perform the obligation of notification are related to the balance between the realization of the consumer's right to know and the protection of trade secrets and intellectual property rights by the operator.This paper firstly compares and analyzes the basic concept and nature of the consumer's right to know and the operator's obligation to inform,and proposes that the consumer's right to know and the operator's obligation to inform have a mutually reinforcing and mutually restrictive dialectical relationship.Furthermore,through the analysis of the case of the communique,the authors explored the violation of the right to know and the boundaries of fraud,and put forward the idea of combining subjective intention and objective harm.Finally,it lists the common situations in which operators fail to fulfill their obligation to inform and infringe on consumers' right to know,and exposes the grim situation of the current violation of consumers' right to know.This paper believes that the violation of the obligation of disclosure by the operator and the different degrees of infringement of the consumer's right to know should be subject to legislation,regulatory sanctions by relevant government departments,self-monitoring penalties of industry associations,consumer associations'penalties,and social A variety of penalties,such as the member's report,are based on the principle of uniformity of punishment and punishment,and the corresponding punishments are made according to different levels of severity,so as to achieve a balance between protecting the consumer's right to know and the operator's reasonable performance of the obligation to inform.
