Research About The Public Character System In News Infringement

The development of communication technology has changed the form of mass media.At the same time,since the rapid development of the media,the increasing number of news media infringement cases in recent years is undoubtedly the focus of social attention.Especially in the past two years,many stars have chosen the litigation path against the infringement of the news media,causing a great response from the society.As a defense,public figures are often mentioned by the defendant and used by the court.The discussion of news infringement issues in the legal and judicial practice circles has been ongoing and the need to strengthen research on the public character system has been realized.There are more and more news infringement cases involving public figures.How to limit and protect the personality rights of public figures is particularly important.It involves the personality rights of public figures,as well as freedom of speech,social public interests,public opinion supervision,and citizen knowledge right.The conflict between the two is inevitable,and the concept of public figures has not yet entered the legal norms of our country.In the future,civil law and personality rights laws need to make relevant provisions to find a balance between the two.This paper expounds the public figure system,analyzes the different regulations and practices of each country in the comparative law,summarizes the academic views of public figures in China and the application in judicial trial practice,and points out some problems and defects.I have put forward some opinions and opinions of myself.
