View On The Conflict And Adjustment Of Rights In News Gathering And Privacy Of Public Figures

In recent years,the conflict between rights in news gathering and privacy of public figures has become intense increasingly.The right of news interview is one of the most important rights to realize the freedom of the press,and press freedom is an extension of constitutional freedom of speech.Therefore,the right of news interview is a constitutional right for the purpose of protecting state and social welfare,and has certain public right attribute.The privacy of public figures is a kind of personality right,and it belongs to private law.The conflict between these two rights reflects the conflict between public right and private right to some extent.How to adjust the conflict of two rights is the focus of the current society.This paper adopts the methods of literature research,case study,comparative study and interdisciplinary study.On the basis of sorting out the concepts and characteristics of the right of news interview and the right of privacy of public figures,this paper sorts out the conflicts between the right of news interview and the right of privacy of public figures.This paper analyzes the conflict between two rights in detail from four aspects:value conflicts,the manifestation of conflict,causes of conflict and types of conflict.It also tries to put forward some suggestions on the legal adjustment of the conflict of two rights from four aspects:perfecting the legislation,enhancing the ability of judges to evaluate cases properly in judicial practice,strengthening the self-discipline of the press and enhancing the legal awareness of public figures.This paper aims to provide theoretical support for improving the protection and regulation of rights in news gathering and privacy of public figures in China.It also hopes to help ease the practical conflict between rights in news gathering and privacy of public figures.At present,there is no written news law to protect the right of news interview.There is also a lack of clear provisions on the privacy of public figures.As a result,journalists and public figures often clash.Sometimes,the reporter's interview behavior violates the privacy of public figures.Sometimes,the public figures violate the reporter's right of news interview in order to protect their own privacy.I hope that the superficial analysis in this paper will make a modest contribution to the adjustment of the conflict between the two rights.
