On Intellectual Property Protection Of The Printed Circuit Boards Layout Design

Printed circuit board(PCB),known as the tower of the electronics industry,is an indispensable intermediate in the electronics industry.From the current legal system,there is no separate law or other legal provisions to protect the intellectual property rights of PCB layout design in China.However,in fact,there are disputes about intellectual property rights of PCB layout design.For the protection of intellectual property rights of PCB layout design,Chinese law is still in a blank state,and litigation failure is inevitable.Generally,the plaintiff will bring a lawsuit to the court on the grounds of infringing the copyright of PCB layout design.It is disappointing that the oblige often fails to win the lawsuit.Since the intellectual property disputes in PCB layout design are constant,and the right holders often fail in litigation.So how to protect the intellectual property rights of the right holders of PCB layout design?This is a question worth considering.For this question,the arguments are as follows:Firstly,it is necessary to briefly introduce the legitimacy and significance of PCB,PCB layout design and protection of PCB layout design intellectual property,so as to lead to the protection of PCB layout design intellectual property.Secondly,starting from the existing laws and international treaties at home and abroad,and from both domestic and foreign perspectives,the feasibility of existing laws to protect intellectual property rights of PCB layout design is analyzed and demonstrated,and the basis and defects of intellectual property protection of PCB layout design are studied.It was found that the existing law does not provide comprehensive and complete intellectual property protection for PCB layout design.Finally,based on the fact that the existing protection mode can not protect the intellectual property of PCB layout design,a design concept of intellectual property comprehensive protection mechanism for PCB layout design is proposed.This paper attempts to construct this comprehensive protection mechanism from the two dimensions of internal construction and external construction.External construction includes the implementation of special legislation and the strengthening of administrative relief of PCB layout design.The internal construction mainly refers to strengthening the self-protection of intellectual property rights in PCB enterprises.Among them,the implementation of special legislation is the most important and important measure to strengthen the intellectual property protection of PCB layout design.
