Research On The Administrative Compensation Recovery System

Administrative compensation recovery system is an important part of the State Law of Compensation of China. Its establishment, development and consummation make great sense to Social Democracy. At present, this system is devised too simply and needs to be further regulated. What is more, the academe pays little attention to it. This article aims to give some suggestions to consummate the system through the analysis of its history, present state and theoretical basis.The article consists of six parts--Preface, Chapter 1 to 4 and Conclusion. In the Preface, it gives a brief description of China's administrative compensation recovery system, and points out the limitation of the system and the necessity to consummate it. In Chapter 1, it interprets the concept and the relationship between administrative compensation recovery and national compensation. Then, the author simply introduces the history and concludes the realistic meaning of it. In Chapter 2, it explores the character and makeup factors of the system. In Chapter3, it points out that we must clear up the two premises of the system in order to consummate it. Chapter 4 is the emphasis of the article. It mainly discusses the consummation of the system. It analyzes the prescription, the procedure, the relief and the supervision of compensation recovery, points out the problems consisting in it, and puts forward the suggestions of consummation. In the Conclusion, the author sums up the content of the whole article, and bring forward the expectation to the future.
