The research content of this paper is the limitation of urban motor vehicles and its compensation.This paper starts with the city motor vehicle limit and its compensation system.Firstly,the city's motor vehicle restrictions and its compensation system will be elaborated,statistically and classified.Secondly,it puts forward the problems of urban motor vehicle restriction and its compensation system.For example,the legal attribute of urban motor vehicle restriction measures is not clear,the legality of the restriction measures needs to be discussed,whether the compensation system should be established,and the compensation system for urban motor vehicle restriction is not perfect.Wait.Thirdly,combined with the public property theory in administrative law to explore the legal nature of motor vehicle restriction measures,summarize and study the existing urban motor vehicle restriction system,and carry out the specific urban motor vehicle restriction measures and the purpose of urban motor vehicle restriction system establishment.Classification,from the theoretical point of view to demonstrate the necessity of urban motor vehicle limit compensation system.Finally,it discusses the necessity of establishing a motor vehicle limit compensation system and puts forward suggestions for improvement.The first chapter is the city motor vehicle limit and its compensation system.To solve some of the problems of predecessor.First of all,it is an analysis of the existing urban motor vehicle restriction system.Through standard analysis and empirical analysis combined with the table,the existing motor vehicle restriction measures in each city are summarized.Secondly,the classification measures are classified to provide a basis for the design of the final compensation system.The second chapter,combined with the first chapter,analyzes the statistics of the restricted line system and the compensation measures,and puts forward the problems and shortcomings of the urban motor vehicle restriction system and the existing compensation measures,and solves them one by one.The third chapter is the study of the legal attributes and legality of urban motor vehicle restrictions.To study the administrative compensation of urban motor vehicle restrictions,the legal nature of urban motor vehicle restriction system should be analyzed.First,an overview of the current views of the academic community.Secondly,it evaluates and analyzes these viewpoints,and finally analyzes the legality of urban motor vehicle restrictions from the perspective of norms and public property theory.The fourth part is the necessity of the urban motor vehicle limit administrative compensation system.This part provides support for the necessity of establishing a motor vehicle limit compensation system in many aspects from the perspective of the principle of reliance on interest protection,the principle of proportionality and the theory of administrative compensation.At the end of the article,the author puts forward the suggestions for improving the administrative compensation system for urban motor vehicles.This part analyzes the problem of the existing urban motor vehicle limit administrative compensation system through the second chapter,combined with the classification of the existing urban motor vehicle restriction measures in the first chapter and the third chapter on the legal nature of the urban motor vehicle restriction system.Suggestions for improving the administrative compensation system for urban motor vehicles.The main innovations of this paper are as follows:1.Combining the public property theory of administrative law,the legal attributes of the restrictive measures are analyzed and demonstrated.2.It is recommended to establish a compensation system for urban motor vehicle restrictions to compensate people's losses.
