Research On Family Education Legislation From The Perspective Of Public Policy

The connotation of the theory of state parental rights is that the state,as the guardian,bears the responsibility of looking after the person without legal ability,which is gradually born out of parental rights.And parental right,the most direct embodiment is family education,parents that is,the guardian to take the responsibility of educating the minor children in the family.With the continuous development of social economy,the family structure has undergone significant changes.The number of left-behind families,floating families and single-parent families is on the rise,and the juvenile crime rate is on the rise.Relying only on the internal strength of parents and guardians is weak in family education,and the implementation effect is hardly satisfactory.Family education has gradually entered the public field of vision and evolved from family affairs in the private sector to state affairs.Improving the effect of family education can not only ensure the healthy growth of minors,but also improve the legal system of education,ensure the realization of public interests.Public policy is the general term of a series of policies,including legislative policies,adopted by the state to coordinate social activities and protect public interests through the use of resources.Due to the lack of necessary policy and legal support,the implementation of family education is likely to produce confusion of subjects and shift responsibilities,making it difficult to protect public interests.So this article is based on public policy legislation policy perspective,analysis of the present situation and problems of the family education,by making the domestic education law,the reverse people old ideas about family education,government,schools,social responsibility and function,using the power of the parties jointly promote and improve precision of family education and science,thus promoting the development of family education to the benign direction.Combined with the practical experience of family education in various places,the author puts forward some Suggestions on the legal name,content and style of family education legislation as well as the legislative characteristics.
