Empirical Research On Intellectual Property Protection Of Traditional Knowledge

In recent years,traditional knowledge has gradually entered the public field of vision and attracted more and more attention.The protection of traditional knowledge has also become the focus of academic research.More and more scholars are interested in promoting the development of traditional knowledge through the protection of intellectual property rights.However,because of its traditional and collective characteristics,traditional knowledge is not compatible with the modern intellectual property system,so it is difficult to get full protection.As a way of protecting private rights and interests,the modern intellectual property system is only responsible for the establishment of commercial utilization rules,and can not take into account the origin of the object.Taking the protection of intellectual property rights of intangible cultural heritage in Shexian County of Anhui Province as an example,starting from the development and protection of Hui Mo Inkstone industry,through field research,and taking the measures taken by enterprises and governments in Shexian County in the protection of Hui Mo Inkstone as an entry point,this paper analyses the experience and lessons in the protection of intangible cultural heritage in Shexian County,and from the protection mode of traditional knowledge,the connection with the current intellectual property system,the design of the subject of rights and other aspects,this paper puts forward corresponding suggestions.This suggestion has a certain reference significance for the development of intellectual property protection of traditional knowledge.
