Land disputes are a macro concept and a collection of various types of land conflict.The land dispute resolution mechanism also refers not only to the solution of a certain type of dispute,but to the unified whole of the various solutions to various land disputes.In order to explore the rationality and improvement of China’s current land dispute settlement mechanism,the author divides the paper into five parts:research significance,land dispute overview,land type research,land dispute resolution mechanism rationality analysis and improvement suggestions.First of all,in the first chapter,the research object,research motivation and research purpose are introduced in detail,and the practical significance of studying the land dispute resolution mechanism is illustrated.Secondly,in the second chapter,I made a general introduction to China’s land disputes,from the concept,classification and causes of land disputes.Thirdly,in the third chapter,the type of land disputes in China is studied,and the land disputes are divided into three categories:land ownership disputes,land infringement disputes and land contract disputes,and explain the current three types of laws.The provisions of the settlement mechanism for land disputes.Then,in the fourth chapter,analyzes the allocation of administrative power and judicial power in the land dispute resolution mechanism,and why it is configured in such a way,detailing the legal issues behind the choice of various land dispute resolution methods.Finally,the fifth chapter combines the full text analysis,and makes suggestions on the improvement of the land dispute resolution mechanism from the aspects of legislation,dispute resolution procedures and land system.
