Research On The Right To Be Forgotten And Localization Under The Background Of Big Data

With the new development of Internet technology in the era of big data,personal information data with huge base on the network are collected,stored,mined,analyzed and utilized.when science and technology were underdeveloped,forgetting was human nature,and memory was an exception.However,with the help of modern science and technology and big data,we have a deep-rooted memory of the personal information of some subjects.When the subjects of personal information expect the relevant personal information disclosed on the network to be gradually diluted by people with the change of time,they find that these information will emerge in front of peopled eyes every once in a while,forgetting becomes a luxury in the big data era.In order to solve this problem,the right to be forgotten arises at the historie moment.However,this right has been stimulated and debated by judicial practice circles and the public all over the world since its emergence.As an imported product from the western world,China is still in a wait-and-see state regarding the right to be forgotten.Domestic well-known experts and scholars have their own views on whether the right to be forgotten can become a right,what kind of right it is,the scope of the right and the way to realize it.At present,there are both voices supporting the right to be forgotten and voices opposing the right to be forgotten in our country.There are also three main views on the right attribute of the right to be forgotten,namely " the right to privacy","the right to personal information" and " the new type of personal rights".In this paper,the author will start with the origin and development of the right to be forgotten,and combine the legislative examples of various countries on the right to be forgotten,to clarify the right attribute of the right to be forgotten and to prove its legitimacy,thus proposing the localization construction of the right to be forgotten in our country.
