In the era of big data,data has become an important production material.As a kind of resource,data plays a strategic role in the competition of Internet enterprises.The characteristics of Two-sided Markets and platform operation make the data create enormous transformed benefits.In order to maintain a dominant position,Internet enterprises use data competitive advantage to implement data monopoly,which results in violation of consumer rights and interests,distortion of competition,hindering the interactive effect of big data,and thus hindering the progress and development of the industry.However,due to the particularity of the business model and profit model of Internet enterprises,which are different from traditional industries,it is difficult for the existing anti-monopoly law to identify the illegality of its the monopolistic practices.This paper starts from three kinds of monopolistic practices: monopoly agreements of data algorithm,abuse of dominant position in data market and data-driven operators.This paper analyses how Internet enterprises implement these actions and reviews judicial cases to explore the dilemma of anti-monopoly law in regulating data monopoly of Internet enterprises.In the framework of existing anti-monopoly law in China,it puts forward that in the era of big data,the problem of identifying monopoly of Internet enterprises can be solved by adjusting standards and measuring methods and introducing data value assessment.
