| Digital platforms not only promote high-quality economic development,but also pose certain risks to the healthy operation of the market,among which the monopoly problem of internet platforms is more prominent.Under the influence of bilateral market characteristics,market lock-in effect,and unique business model,Internet platforms are prone to form market monopolies,resulting in abuse of market dominance or concentration of business operators and other monopolistic behaviors,which then lead to price discrimination,diversification of merger forms,algorithm driven implicit collusion,privacy disclosure and other issues.These issues will have a series of negative impacts on platform operators,competitors,and consumers.The previous antitrust standards and countermeasures aimed at traditional market regulation can no longer adapt to the new situation of the development of monopolistic behavior on internet platforms.The current regulation of monopolistic behavior on internet platforms faces severe challenges,including insufficient digital governance capabilities,and the need to improve the methods and capabilities of antitrust law enforcement.In this regard,based on the actual situation in China,learning from the successful practices of the United States,Germany,and the European Union in the supervision of internet platform monopolies,and in response to the characteristics of China’s internet platform monopolistic behavior,we propose improvement suggestions from the aspects of antitrust regulatory rules,algorithm monitoring,digital supervision,and the construction of antitrust systems.This article explores from the following sections.The first part mainly provides an overview and theoretical analysis of the regulatory issues related to monopolistic behavior on internet platforms.Starting from the definition,classification,and current development status of platform economy of internet platforms,it analyzes the reasons for the formation of monopolies,and then focuses on analyzing the specific behaviors and essence of internet platform monopolies,and summarizes their characteristics accordingly.Then,the impact of internet platform monopoly was analyzed from the perspectives of peers,platform operators,and consumers.Secondly,the basic theories of regulation in the field of internet platforms were also analyzed.Finally,analyze the necessity and feasibility of strengthening and improving the supervision of monopolistic behavior on internet platforms.The second part analyzes the problems in the supervision of monopolistic behavior on internet platforms.Internet platforms pose challenges to antitrust regulatory rules,their algorithmic advantages hinder antitrust regulation,their data monopoly issues are difficult to regulate,and there are some issues with current antitrust regulatory enforcement.The third part specifically analyzes and compares some experiences of the United States,Germany,and the European Union in the field of antitrust regulation on internet platforms,summarizes the gains and losses,and obtains some inspiration closely based on the actual situation in China.The fourth part proposes suggestions from optimizing the top-level design to improve the antitrust analysis framework and standards,utilizing technology regulation and continuously strengthening digital regulatory capabilities,and improving regulatory efficiency. |
