Research On The Problem Of The Abuse Of Litigation Rights Of Citizens Under The Government Information Disclosure

With the implementation of Regulation of the People's Republic of China on the Disclosure of Government Information,China's government information disclosure field has made significant progress.The number of lawsuits related to the disclosure of government information is also at a high level.While protecting the citizens' right to access government information,the related litigation also causes the problem of abuse.Many cases drag on indefinitely,affecting the social order and undermining the stability of the law.A large amount of judicial or administrative resources are wasted on these cases every year,resulting in a relatively bad social impact.This paper focuses on the problem of citizen abuse under the government information disclosure system.The paper is divided into five parts and discusses the problem from different aspects.The first part is the introduction,which elaborates on the abuses caused by the abuse of rights and domestic and foreign research theories on the abuse of citizens under the government information disclosure system.The second part introduces the development history of China's government information disclosure litigation and the conditions of prosecution and acceptance.At present,the people's courts in China generally adopt the criteria for determining the qualifications of unrestricted plaintiffs.Citizens do not need to explain the reasons for applying for government information disclosure,nor do they need to explain the interests between themselves and the information they apply for.The third part,through the method of case analysis,for nearly four years about the government information publicity has erected 272 v.the written judgment of carding and induction,summarized under the government information publicity system,citizen rampant litigation of the six major problems,such as rampant litigation behavior person to conceal true purpose false meaning,widely accused of administrative organs,mainly related to areas of significant livelihood of the people,and so on.The fourth part analyzes the causes of citizen abuse under the government information disclosure system.On the one hand,there are still omissions in the legal system;on the other hand,the abuse of citizens' rights has caused great troubles to the state administrative andjudicial organs.The fifth part,combining the characteristics and causes of abuse,discusses the methods of alleviating related problems,such as the use of "situation description" system,the establishment of citizens' credit list mechanism.
