Research On Prison Penalty Execution And Reform Ideas

The execution of prison penalty is the last link in the whole criminal procedure.Not only is it related to the integrity of the whole criminal proceedings,but also whether the purpose of punishing crimes and protecting the people by criminal law can be realized.However,there are still some problems in the execution of prison penalty that cannot be ignored at present,it is worth studying and needing reform.On January 27,2018,at the fifth member congress of the China Prison Service Association,Zhang Jun,then Minister of Justice,stressed that the overall national security concept should be implemented with the fundamental security concept of prison work.On June 29,2018,at the National Conference on Prison Work,Fu Zhenghua,minister of Justice,emphasized the overall promotion of the new pattern of the five major reforms led by political reform,we should strive to open up a new situation of prison work in an innovative era.This article starts from the concept of prison penalty execution,it systematically expounds the three elements and five principles of prison penalty execution,finds out the essence of prison penalty execution.It provides a theoretical basis for the follow-up research and reform ideas.Then,it focuses on the problems existing in the current execution of prison sentences from three levels,and reflectes the causes of the problem deeply.Finally,under the background of the new era and prison system reform,from four aspects it explores the reform ideas of prison penalty execution,proposes specific measures.The purpose of this article is to make suggestions and suggestions for further improving the execution of prison sentences in the new era.
