In the decision of the Central Committee of the Communist Party of China on several important issues of promoting the Rule of Law in an all-round way,adopted by the fourth Plenary session of the 18 th National Congress of the CPC Central Committee,five major systems for the construction of social legal system are proposed: forming a complete system of legal norms and efficient implementation of the rule of law Strict supervision system of rule of law and strong guarantee system of rule of law form a perfect system of inner-party laws and regulations.The strict supervision system of the rule of law has great practical value and practical significance in the construction of the legal system.Based on the methodology of positivism,this paper takes the popular case of Changchun vaccine as a sample.Applying the knowledge of jurisprudence,through the combination of theory and practice,the paper discusses the method of combining theory with practice.Based on the puzzlement and challenge of the legal supervision system,this paper demonstrates the theoretical basis,legal principles and ways and means of the ad hoc legal supervision system in China.Using the above-mentioned principles,this paper analyzes the case of Changchun vaccine incident and the relevant legal supervision system,analyzes the current legal situation and its problems after the vaccine incident from the perspective of the rule of law of safety supervision,and studies the research and development,examination and approval,listing,production,circulation and use of vaccines.After-sale vaccine regulatory behavior and compliance with the legal basis and system improvement issues.This paper mainly includes five parts: the first chapter is the introduction.This paper mainly introduces the research status of vaccine safety supervision in China,the background and significance of this study,and then puts forward the research methods in this paper.The second chapter is the current situation of vaccine safety regulation law in China.First of all,to regulate the safety of existing vaccines.The relevant legislative provisions are elaborated.Secondly,analyze the legislation system of vaccine supervision in our country.Finally,the need to strengthen vaccine regulation is emphasized.The third chapter is the comparative study of foreign vaccine safety regulatory legal system and its enlightenment,through the United States,Britain,Japan and Canada,the four national vaccine safety regulatory systems and related legal provisions,on the basis of comparative analysis,Abstract the advanced experience of foreign countries and discuss the enlightenment to our country from the legal system of vaccine safety supervision in foreign countries.The fourth chapter is about the problems and reasons of the rule of law of vaccine safety supervision in our country.First of all,the problems existing in the rule of law of vaccine safety supervision are comprehensively analyzed.Then,the causes of the problems are analyzed completely.The fifth chapter is to perfect our country vaccine safety supervision rule of law suggestion.In view of the problems found above,the corresponding legal advice is put forward,mainly from the following four aspects: establishing strict vaccine supervision legislation,perfecting vaccine information management and public system,strengthening administrative inspection and law enforcement,and perfecting relief system.
