Study On Compensation For Interruption Loss

It is generally believed that the interruption loss belongs to property loss.As a kind of property loss,the interruption loss is a kind of loss caused by the infringement of the use right of property.Through research on Comparative Law,the interruption loss has an independent property value attribute,which has been recognized by most countries.To the extent that compensation is a prerequisite for the interruption loss to obtain compensate.Based on the relative research of Comparative Law and case judgment in our country’s practice,this paper analyzes the compensation for interruption loss from the perspective of its internal attributes,external infringement,breach of contract,etc.This paper attempts to analyse the remedies of interruption loss in the light of the specific circumstances that arise in practice cases.Emphasis of discussion is the exemption of insurance companies in the damage compensation of interruption loss.Finally,the calculation method of interruption loss is discussed.With a view to achieve the filling of this type of compensation.
