Interpretation Of The Arrangement For Recognition And Enforcement Of Judgements In Civil Cases Of Marriage And Family Between The Mainland And Hong Kong

On June 20,2017,Shendeyong,Executive Vice President of the Supreme People's Court,and Yuan Guoqiang,Secretary for Justice of the Hong Kong Special Administrative Region,signed the "Arrangement on Mutual Recognition and Enforcement of Judgements in Civil Cases of Marriage and Family between the Courts of the Mainland and the Hong Kong Special Administrative Region" in Hong Kong.Although the above arrangement has not yet been formally promulgated and implemented,However,once the civil cases of marriage and family between the Mainland and Hong Kong courts are implemented,they will be able to recognize and enforce each other.This will be of great significance for the settlement of inter-Hong Kong marriage and family disputes.Judicial cooperation between the Mainland and Hong Kong in the field of marriage and family will gain more space.This is a result of the deepening of judicial cooperation between the Mainland and Hong Kong over the years.It is conducive to enhancing mutual judicial trust and cooperation between the Mainland and Hong Kong and jointly promoting the economic prosperity of the Mainland and Hong Kong.In order to achieve this objective,the above arrangement clearly stipulates the matters related to the recognition and enforcement of judgments in civil cases of marriage and family,and facilitates the application of the parties,as well as the recognition and enforcement of the Hong Kong and Mainland courts.However,the author believes that there are also some unclear areas that need to be improved.Through the analysis of the shortcomings of the above arrangements in the light of practical cases,in order to attract the attention of other readers,we can jointly promote judicial cooperation between the Mainland and Hong Kong in the field of marriage and family.At the same time,in order to learn from other countries 'mutual recognition and execution of inter-regional marriage and family judgments,this article interprets the content of the arrangement.To study the recognition and enforcement ofcivil judgments in marriage and family cases in mainland China and Hong Kong in the light of the characteristics of recognition and enforcement of judgments in civil cases of marriage and family in the United Kingdom,the European Union and the United States.In the context of "one country,two systems" in our country,the author puts forward the places that need attention in the implementation of the above arrangements and the relevant suggestions for improvement in order to implement the mutual recognition and enforcement of civil cases between Hong Kong and mainland marriages and families.
