Investigation Report On The Implementation Of The Criminal Legal Aid System In Tongliao City

Legal aid system occupies an important position in the national judicial system.Improving the legal aid system has always been one of the key points of judicial reform in China.In criminal proceedings,the promotion of legal aid for criminal defense is of great significance to strengthen the protection of the human rights of criminal suspects and defendants and to promote judicial justice.The Nineteenth National Congress of the Communist Party of China put forward a new era requirement for perfecting the legal aid system of criminal defense in an all-round way by upholding the rule of law,strengthening the protection of human rights and the construction of the rule of law.It is not enough that we merely depends on the tools of law.The vitality of law depends on its implementation.As a staff member of Tongliao Judicial Bureau,through years of work,I have contacted with a certain number of legal aid cases,and had a thorough understanding of the current situation and existing problems of criminal legal aid work in this area.This paper makes a comprehensive and in-depth study on the current situation of the legal aid system at home and abroad by using the method of literature analysis,and conducts a field investigation on the implementation of the criminal legal aid system in Tongliao City by using the methods of data collection,questionnaire survey and on-site interview.According to the statistical analysis of the investigation data,it is concluded that the governments at Tongliao city and county levels do not pay enough attention to the work of criminal legal aid,the judicial concept of human rights protection has not yet been fully established,the propaganda of judicial administrative organs is not active,the regulation of lawyer resources is unreasonable,the distribution mode of cases is not scientific,the quality supervision is not in place,and the incentive mechanism is not efficient.This paper analyses the causes of the problems from the three dimensions of economy,politics and culture,and puts forward strengthening the sense of government responsibility,creating public lawyer defense mode,strengthening the construction of legal aid team,paying attention to the training of legal service personnel in Mongolian andChinese bilingual languages,establishing the subject status of financial support,diversifying the channels of fund-raising,and perfecting criminal law for improving and perfecting the work of criminal legal aid in Tongliao area,and constructing an industrial legal aid support system's specific proposals.The thesis is divided into four parts: the first part is the introduction,mainly introduces the research background,research significance,research content and research methods,and reviews the research status of the criminal legal aid system at home and abroad.The second part of the implementation of the criminal legal aid system in Tongliao City,through data statistics and research interviews,in order to find out the problems existing in the implementation of the criminal legal aid system in Tongliao City;The third part is the analysis of the problems existing in the implementation of the criminal legal aid system in Tongliao City and the fourth part is the suggestion to perfect the implementation of the criminal legal aid system in Tongliao City.
