Research On Several Issues Concerning The Administrative Filing Of The Owners' Committee In China

As an important administrative management tool in China,administrative filing is more moderate than administrative licensing,and administrative departments at all levels use it extensively in practice.However,at present,China's administrative filing system is not perfect,and no unified legal provisions have been formulated.The administrative filing of the owners' committee is an important part of China's administrative filing system.The administrative department reviewed and filed the owners' committee according to law,and strengthened the supervision and management of the owners' committee.The current laws and regulations on the filing of the owners' committee are also quite rough,lacking maneuverability and need to be further standardized.In practice,the administrative department has unclear understanding of the nature of the filing of the owners' committee,and the review methods are different,and there are differences in the local courts' understanding of whether the filing behavior is actionable,resulting in different judgments in the same case.Based on the administrative filing disputes of the owners' committee,this paper clarifies the differences between administrative filing and related concepts,expounds the connotation and nature of the administrative filing of the owners' committee,analyzes the problems and causes in the current administrative filing of the owners' committee,analyzes and discusses the judicial review of the adjudication of the administrative filing of the committee.Finally,puts forward relevant suggestions based on the current situation of the administrative filing.
