Research On Issues Related To Copyright Protection Of Museum Resources

Under the background of the development of contemporary museum culture industry,it has become the common task and challenge for all museums to make full use of the resources of museums to develop intellectual property.In the development of museum resources,a large number of excellent works have been created,but at the same time,museums are also faced with a variety of intellectual property disputes,among which copyright disputes account for a large proportion.By analyzing typical cases of copyright protection of museum resources,this paper summarizes the problems existing in the copyright protection of museum resources in China,such as unclear definition of protection scope,frequent disputes over ownership of rights,and imperfect mechanism for exercising rights of museums.Starting with the case,this paper classifies the resources of the museum and summarizes the existing legal provisions and research results.This paper discusses the scope of copyright protection of museum resources,the reasonableness of museum as the subject of copyright rights,and the reason that museums should grasp the copyright exception and its limitation when exercising their rights on the basis of the principle of balance of interests.Through the discussion of these aspects,this paper expounds the problems encountered in the copyright protection of museum resources and the solutions to these problems.Museum resources copyright protection shall follow the principle of balancing of interests,the principle of public interest and the principle of copyright restrictions,and put forward in the natural resources copyright protection by setting the work list,use the copyright registration management system,and optimize the copyright collective management system,to regulate the museum resources management and protection of the copyright.
