| In order to further highlight the historical and cultural value of museum resources,and to bring into play the socially beneficial functions of museums,the rational exploitation of museum resources has become a development trend.China encourages museums to vigorously develop the cultural and creative industries,but the development of cultural and creative museums in China has also encountered a bottleneck.The most central issue is the property rights of museum collections.Through the analysis of the current situation of the development and utilisation of museum collections in China,it is found that there are three most prominent copyright problems,namely,unclear ownership of the copyright of the collections,controversial qualification of museum copyright subjects and imperfect authorisation mechanism of museums in the process of resource development and utilisation.Based on the above-mentioned problems,the paper proceeds in accordance with the logical ideas of identifying,using and authorising rights,and proposes that in the process of developing and utilising museum collection resources,a system of registering the copyright of collection resources,improving the governance structure of museums,and constructing a mechanism for authorising public resources should be adopted.The proposal of regulating the development and utilization of copyright of museum collection resources by constructing a registration list system for collection resources,improving the governance structure of legal persons and building a public resources trading platform. |
