The traditional paper-based bills,due to the defects of their natural carriers and the lag of China's “Bill Law” legislation,have led to chaos in the bill market.As a new technology,“block-chain” has the characteristics of decentralization,time stamp and smart contract.These characteristics coincide with some characteristics of the bill.The perfect combination of the two has spawned a new type.The form of the bill-the digital bill,its appearance can effectively regulate the chaos of the bill market in China.Digital bills based on the block-chain background are a new form of bills.Compared with traditional bills,digital bills are safer,more efficient,and more adaptable to the current trend of electronic payment.In essence,Digital bills are a new form of bills combined with traditional paper bills and block-chain technology.They do not subvert the traditional bill system.On the contrary,digital bills have both the existing rules of bills in China and conflict and innovation.At present,the digital bills based on the block-chain background have not been widely used in China.The research on digital bills outside the domain is ahead of China.Through the research on the advanced experience of the extraterritorial digital bill system,the problems of China's digital bill system are analyzed.The blank of the digital bill legislation,the related concepts are not clear,and the legal relationship is not clear.Then put forward the thinking of constructing the legal system of digital bills in China: First,perfecting China's bill legislation and establishing the status of digital bills in China's bill legal system;secondly,clarify the legal relationship of digital bills and guarantee;Third,the establishment of a unified digital bill trading platform,so that digital bills can play a better role.
