Experienced in the era of rapid economic development with the wasting of Green mountains and rivers,environmental issues have become increasingly prominent,and the protection of environmental public interests has become a new demand of era.Correspondingly,the institutional design of environmental public interest litigation has also undergone a process from scratch.The improvement of the environmental public interest litigation system is also an inevitable requirement for the development of the times and environmental protection.At present,the use of environmental public interest litigation systems is more commonly seen in the public administration of environmental public interest lawsuits dominated by public power.In the judicial practice,the issue of the qualification of the plaintiff's subject is a common problem in China's environmental civil public interest litigation cases.Because the subject qualification problem also leads to social participation and governance effects of environmental protection is not ideal.Therefore,through case analysis and theoretical analysis,this paper attempts to demonstrate that environmental public interest can be better protected by expanding the scope of the starting body of environmental civil public interest litigation.The first part of this paper briefly introduces the main body of foreign environmental public interest litigation and related theories.The second part discusses the current situation and the gains and losses of the main body of environmental public interest litigation in China.The third part discusses the necessity of expanding the scope of environmental civil public interest litigation subject.In the fourth part,we discuss the issue of the sequencing that is derived from the expansion of the main body.
