On The Criminal Reconciliation System Of Minor Criminal Cases

As a new concept of criminal justice,criminal reconciliation,since the 70 s of last century has gradually in the worldwide rise,2012 China the criminal law amendment officially in the criminal reconciliation system into the code,but only misdemeanor and criminal negligence.In recent years,our country exist a large number of criminal reconciliation in the judicial practice,there are also part of a criminal case private phenomenon,judicial practice and private phenomena are to minors has greater tolerance,not adults because of its age,cognitive ability and self control ability than adults are low,the felon also than adults are more likely to get understanding and forgiveness and protection.However,the criminal procedure law of our country has not will not adult felony criminal reconciliation system write code,compared to the judicial practice in China is lagging behind,the deficiency of the system is not conducive to the adult rights judicial protection.In this paper,we put forward some exploration and ideas on the criminal settlement of juvenile cases of serious crimes.The first chapter of this paper introduces the application of the criminal reconciliationsystem of basic theory and foreign,the second chapter focuses on minors in criminal felony cases of reconciliation in present the necessity and feasibility,the third chapter introduced situation of the domestic application of criminal reconciliation,and carries on the case analysis,the fourth chapter discusses the problems of China's adult felony cases of criminal reconciliation judicial practice exist in,chapter five discussed without adult felony criminal settlement system construction,in order to form a perfect juvenile felony cases of criminal reconciliation system.
