Study On The Rights Of Individuals In Internet Credit

This paper introduces the development background of Internet finance in China and the important role the Internet credit technology plays in reducing transaction risks and enhancing financial inclusion,the internet credit will be extremely potential in individual credit field.Even though the Internet credit has greatly expanded the scope of credit information,the basic theory in the legal relationship of credit can still serve as great help in analyzing the interests and rights of individuals at present.This paper summarizes the current mainstream credit and credit theories,expands the coverage of credit activity,and holds the opinion that we should analyze the rights and interests of individuals in the dynamic change of credit information.Current theories usually focused on discussing the methods of data processing and credit assessment,or directly analyzing the way to frame regulatory system,which ignored the fact the key issue in the administration of credit industry should be issue of information property.This paper compares the definition of intellectual property and takes the quality of credit as a guide,mainly analyses the inherent economic interests' property of credit information,and regards the credit information as as property when discussing.Due to the fact that the credit information property configuration is complex in practice,this paper analyzes the effects of various single property configuration policy progressively,and comes up with the property configuration strategy of conditional share,deprive information subject's property of negative information,which has laid a solid foundation for the analysis of rights and interests of information subject.At last,this paper analyzes the rights and interests which shall be enjoyed by the information subject in the dynamic change of credit information.
