Shanghai is a famous historical and cultural city in China.Because Shanghai integrates eastern and western cultures,the historical blocks and architectures in Shanghai have become its unique urban landscapes.Shanghai carried out the protection work of cultural heritages earlier than other municipalities and provinces.On July 25th,2002,the 41st session of the standing committee of the 11th people's congress of Shanghai passed and promulgated the“Regulations of Shanghai Municipality on the Protection of the Areas with Historical Cultural Features and the Excellent Historical Buildings”.In terms of legal protection scope,the historic and artistic blocks and buildings are usually protected while the widely-distributed lane blocks with ordinary art value in central Shanghai are not protected.The significance of preserving the lane(block)is not only because of its close relationship with the local residents.As a unique image of the city,it is also a production produced only in Shanghai,China by combining modern western commercial civilization with Chinese traditional way of life.In the heyday of lanes,the total construction area of the lanes in Shanghai was about 20,000,000m~2,and the area of the shikumen lanes accounted for three-quarters of the total area of all the lanes.With the rapid development of the city,the traditional lane blocks in Shanghai have lost their former brilliance.Because of the various factors and conflicts such as the surge of the population,the backward of the buildings'interior facilities,the old structures,the complex building property rights,and that the existing protection policy has limited coverage,it is more and more difficult for the lanes to meet the basic living needs of the residents,and the construction load and the safety pressure are close to the limit.Since the 21st century,the number of lane blocks continues to decline,and their distribution range is narrowing.Since the 1990's,Shanghai's old block reconstruction policy is building new buildings after demolishing the old ones.According to the incomplete statistics,during that period,nearly 1,000,000 old block residents moved from the downtown area to the suburbs.As the residents'resettlement destinations keep moving to the edge of the city,the public interests are sacrificed,the social equity and justice cannot be guaranteed,and the limitation of the city's development strategy appears.This paper is divided into four chapters.The first chapter mainly introduces the related concepts of the historical conservation areas,the conservation roads,buildings and lane blocks,as well as the selected topic's background,the research's purpose and significance,and the adopted research technique,etc.,and introduces the related research situation at home and abroad.The second chapter first analyzes the theory and practice of the protection of Shanghai historical landscapes,points out the core issue of the protection and update of Shanghai lane blocks,then introduces the protection situation of the lane blocks in Shanghai,and analyzes the protection practice through the cases in Xintiandi,Tianzifang and East Sivenli.The third chapter mainly analyzes legal protection of the historical and cultural blocks in the countries such as Britain,France and Japan,and analyses the western experience and enlightenment on the protection legislation for our country in terms of the legislation,administration and public participation.The fourth chapter analyzes the legislation thinking and suggestions on the cultural protection and utilization of the lane blocks,in order to provide the reference to the local legislation practice of protection and update of Shanghai lane blocks.
