Research On The Legal Regulations Of Pension Agencies From The Perspective Of Protection Of The Rights And Interests Of The Elderly

China has entered an aging society.With the change of family structure caused by social and economic development,the traditional family pension model can no longer meet the needs of the elderly.The social pension model has gradually emerged and developed.As the carrier of the social pension service system in China,the pension institution undertakes the role of providing old-age services and protecting the rights and interests of the elderly.It is to solve the problem of the elderly and promote the elderly career in China.The article is divided into six parts,including the introduction.The introduction leads to the research object of this paper through the case of disputes between the old-age institutions and the elderly residents,namely,the legal regulation of the old-age institutions in the perspective of the protection of the rights and interests of the elderly,and through the relevant literature combing,establishes the starting point of this study.The second part is the evolution of social aging and pension institutions.By combing the emergence and evolution of pension institutions under the trend of aging,the value orientation of pension institutions is clear,which lays a theoretical foundation for the following research on the types and paths of protection of the rights and interests of the elderly in pension institutions.The third part is about the rights and interests of the elderly in the pension institutions and their protection.It mainly sorts out the rights and interests of the elderly in the pension institutions,analyses the ways to realize the rights and interests,and summarizes the status of the realization of the rights and interests,in order to provide a realistic basis for the following analysis of the satisfaction degree of the legal system to protect the rights and interests of the elderly to the needs of the elderly.The fourth part is the legal regulation of the protection of the rights and interests of the elderly in China's pension institutions.This part firstly combs the basic situation of the legal regulation of the protection of the rights and interests of the elderly in China's pension institutions,analyses the legal rank as the standard and discusses the defects of the system,with a view to pointing out the direction for the following construction of a suitable regulation model for China's pension institutions.The fifth part makes a comparative study on the legal regulation of foreign pension institutions.This part uses comparative research methods to introduce different types of foreign pension institutions legal regulation model,hoping to provide reference for our country in the context of combining the actual situation of our country.In the sixth part,the author puts forward the idea of constructing the regulation mode of the public power supervision-led pension institutions.On the basis of the above parts,the author summarizes that the pension institutions in the perspective of the protection of the rights and interests of the elderly in China can adopt the mode of combining contract freedom with public power supervision to regulate,and elaborates separately from the realization mode and system suggestion level.This paper uses literature analysis method to study the needs of the elderly and the ways and status quo of protecting their rights and interests in the process of the emergence and evolution of pension institutions,grasps the frontier theory and clarifies the research ideas;secondly,the comparative analysis method,through the comparative study of the legal regulations of foreign pension institutions,analyzes the regulations of foreign multi-national pension institutions.The model can provide institutional reference for the construction of the regulatory model of our country's characteristic pension institutions.
