In 2018,China-US trade frictions continued.On January 16,2019,the United States and submit a report to the WTO general council report's main problem is put forward by the WTO: now that developing countries are themselves,many developing countries has been rapid development in recent years,has reached the level of developed countries,they continue to enjoy the special and discrimination,damage the interests of developed countries.Therefore,under the background of sino-us trade friction,developed countries try to cancel the status of China as a developing country,and cancel the special and differential treatment enjoyed by developing countries.However,fairness and mutual benefit are the premise of international cooperation and development,and the special and differential treatment enjoyed by developing countries is unshakable.Obviously,the application of the principle of special and differential treatment in developing countries is a controversial issue.This paper systematically analyzes the principle of special and differenti al treatment and the identification of developing countries.This paper mainly explains the meaning,content and development process of the principle of special and differential treatment.The general contribution of the principle of special and differenti al treatment and its application in China are summarized.It has exhausted 155 special and differential treatment clauses in WTO agreements,and analyzed the problems and shortcomings of these 155 special and differential treatment clauses.It is mainly reflected in the vagueness of terms,the relativity of the concept of development and the restriction of GSP.Finally,it puts forward some Suggestions on the application of the principle of special and differential treatment and indicates that China always adheres to the position of developing country status.
