The treatment of developing countries is one of the focuses in the reform of WTO.Since the birth of GATT,special and differential treatment(SDT)also has sufficient theoretical and practical basis in the changeable trade system dominated by WTO.It is not only in line with the purpose of the establishment of WTO,but also an important achievement of solidarity,hard work and long-term unremitting struggle of developing countries.Therefore,giving SDT treatment to developing countries is not only in line with the needs of economic reality,but also in line with the fairness and justice pursued by the law.This is not only the right of developing countries,but also the legal obligation of developed countries.At present,in the WTO legal norm system.the SDT treatment for developing countries has significant defects,so the reform is imperative.This is manifested as follows: first,the relevant clauses are fuzzy,the legal obligations are not clear,and that enforcement is poor;second,the system design is not perfect,the implementation effect of the clauses is bad and the national capacity-building of developing countries is ignored;third,the identification procedure of "developing countries" is true,and the classification of countries is divorced from the current situation of world economic development,which leads to more SDT treatment clauses Unstable and unpredictable.In order to better improve the clauses of SDT treatment and protect developing countries' due institutional interests in the multilateral trading system,the first is to improve the relevant clauses of differential treatment,clarify the connotation of legal obligations in the clauses and the implementation standards of legal obligations;the second is to pay attention to the system construction of the clauses of SDT treatment In addition to establishing the supervision mechanism of SDT treatment clauses,we should fundamentally solve the problem of the lack of capacity of developing countries,so as to fundamentally solve the imbalance of rights and obligations between developing countries and developed countries in the multilateral trading system,so as to obtain more institutional benefits;third,we should proceed from a realistic point of view and seek truth from facts while maintaining the concept of "developing countries" Based on the real national interests of developing countries,we should formulate SDT treatment in line with the actual needs of developing countries.
