Research On The Criminal Reconciliation System In China

In harmony with the social legal system under the background of criminal justice policies complement each other more and more important role in criminal reconciliation and leniency,its system value and practical significance is more and more widespread concern in all sectors of society.The criminal reconciliation system is applied to solve the problem of contradiction in the criminal investigation stage of public security,and gradually became the adaptation and deepen the reform of the judicial system and the situation of the public security organ to one of the important ways to safeguard national stability and social harmony.Whether the application of criminal reconciliation system should be applied in public security is still controversial.However,the application of the criminal reconciliation system in the stage of public security has been proved by practice that it is necessary and feasible.The new "criminal procedural law" in the revised introduction,also explicitly defined in the public security investigation phase of the application of criminal reconciliation system is legal,and the reality of the legal environment is appropriate,so as to further establish the legal status of criminal reconciliation.The article is divided into three parts,the first part is about the "status quo" investigation of criminal reconciliation in China,namely in C city as an example,an empirical study of the two aspects of legislation and judicature of the existing summary of the investigation stage in China in the process of reconciliation problems.The second part is the legislative and judicial status quo analysis for the investigation stage of criminal reconciliation by the first part of the study and summarizes the existing problems,such as "narrow scope" and "Compulsory Settlement","prone to abuse of power" and "the compensation standard is not unified,the way of conciliation too much of a single" and "reconciliation results uncertainty" and other issues,and in-depth analysis of its problems,lead to explore the reason of its appearance.Finally,the author puts forward the perfect path for the above problems,in order to make some contribution to the criminal reconciliation system.In a word,the judicial practice of criminal reconciliation in our country shows that the system has certain legal effect and social effect,but it still needs to be improved in order to improve the internal and external factors.We should improve the legal system,change the concept of justice,improve the supporting measures to promote the development of criminal reconciliation system,and actively build a socialist society with Chinese characteristics.
