Research On Supervision Committee's Lien Measures

Since the Eighteenth National Congress of the Communist Party of China,China's anti-corruption struggle has made great achievements,and the official corruption has been curbed.However,China's current anti-corruption form is too singleness and still relies on violence against corruption.In order to realize the normalization and specialization of the anti-corruption struggle,the state has embarked on a line of anti-corruption relying on the system,integrated the existing anti-corruption agencies,and established a new anti-corruption specialized agency-the National Supervision Committee.The Supervision Law of the People's Republic of China gives the Supervisory Committee the implementation of lien measures when investigating corruption cases.The imp lementation of the Lien measures can greatly facilitate the exercise of the supervisory power.However,due to its own strictness,the improper use of the lien will violate human rights and damage the legal rights of the respondent.Therefore,the procedures for its operation should be strengthened in accordance with the law.The article will elaborate on the specification of the Lien measures from four parts.The first part mainly analyzes the basic theory of the retention measures and the legal basis and realistic basis on which they are based.The second part mainly analyzes the status quo and problems of the current implementation status and existing problems of the retention measures,including the startup procedures,approval procedures,and implementa tion procedures.The third part mainly analyzes the similar systems of extraterritorial countries and the reference significance for the improvement of China's lien measures,including the investigation of relevant systems in Singapore,Hong Kong,the United States and Japan,and draws lessons from ideas and procedures.The fourth part mainly proposes corresponding solutions to the problems of China's retention measures,including the improvement of procedures and supervision.
