Research On Judicial Protection Of Women's Rights And Interests In Divorce Proceedings

The protection of women's rights and interests is a yardstick to measure the social progress of a country or region.Women have always been the vulnerable groups in society.Abuse of women often occurs in marriage and family life.With the increasing number of divorce cases in China,the number of divorced women is gradually growing.Although the society no longer discriminates against divorced women,their living conditions are not optimistic,and the protection of divorced women's rights and interests is obviously prominent.After divorce,women have no place of residence,no home and it is difficult to implement their due property rights.However,due to various reasons,women who suffer from domestic violence have no evidence to prove it.Divorce proceedings involve many rights and interests of women,such as marriage and family rights,property rights,personal rights and so on.At present,the marriage law and other relevant laws have not paid enough attention to these aspects of the problem.Divorce women's rights and interests can not be effectively guaranteed,will directly lead to their survival crisis,but also to the social stability of the increase of hidden dangers,negative impact on the construction of a harmonious society.This article selects the divorce of women's right to the contracted management of land,damage to the purchasing and children visitation of the three typical problems,from women's rights in divorce lawsuit judicial protection present situation,analyzes the divorce of the problems existing in the judicial protection of women's rights and analyzes the reason,combining with the developed countries solve the divorced women rights and interests of foreign experience,put forward specific proposals.It is also hoped that through this article,the whole society will pay more attention to the special group of divorced women,so as to better protect their rights and interests and realize the real gender equality.
