| With the rapid development of large data,brain neuroscience and other research,the development trend of artificial intelligence is also unprecedented.From dark blue to alpha dogs,AI has mastered autonomous learning.As far as social construction is concerned,it promotes the improvement of the overall social construction in an all-round way,but the unpredictability of AI also makes people experience new topics.Uncertainty has a great impact on China’s social economy and the impact on China’s economic law is unavoidable.Among them,the prominent performance is the application of product development risk in the Product Quality Law.There are many disputes on this issue itself.Because of the unique particularity of AI products,AI products are produced.Definition of AI product defect in product development risk,and determination of AI product development risk technology level become more elusive.This paper combines the strict liability of AI product quality responsibility with product defect and product development risk.Under the existing strict liability,the limitation of AI product defect through the existing technology level in the development risk can reduce the scope of strict liability.On this basis,the selection and construction of AI product defect standards are discussed.Meanwhile,the scientific and technological level standards of AI product development risk are analyzed by consequence theory in law and economics,and the applicable standards are compared,thus a relatively reasonable result is obtained.Finally,it also discusses how to construct a reasonable supporting measure to deal with the possible adverse effects of using this method,such as establishing insurance system,adjusting the responsibilities of AI producers and consumers,as a global supplement to the development risks of AI products. |
