Due to the Notice on Strengthening Television Reports and Broadcast Management of Sports Competitions issued in 2000(2000 Notice)by the State Administration of Press,Publication,Radio,Film and Television of the People's Republic of China,China Central Television(CCTV)has the exclusive rights to buy the broadcasting rights including the Olympic Games,Asian Games,the World Cup and other major events.Notice on improving the Television Reports and Broadcasting Management issued in 2016(2016 Notice)has limited the exclusive rights to the Olympic Games,Asian Games and the World Cup,which embodies the direction of reform.It is still controversial to determine whether the 2016 Notice is in line with the law and whether the exclusive rights of CCTV is anti-competitive.This article tries to start from the perspective of the fair competition censorship,analyzing the whether the 2016 Notice conforms to the review standards of the fair competition censorship in order to regulate the sports broadcasting right of China.This Article is divided into six chapters.The first chapter introduces the background of this article and the reason why the fair competition censorship should be applied.The second chapter introduces whether the exclusive rights of CCTV violate the Antitrust Law and major in the rationalities and shortcomings of this behavior as well as some affairs related to antitrust.The third chapter introduceswhether the behavior of CCTV should be regulated by the antitrust law in order to analyze the objects of antitrust law and the current research on the sports broadcasting rights.The fourth chapter introduced the fair competition censorship from the primary analysis of the Fair Competition Censorship Regulations(Provisional)to explore how to use this system to analyze the 2016 Notice.The Fifth Chapter introduces the possible problems the sports broadcasting market may meet in the future.The Six Chapter is conclusion that the 2016 Notice and the exclusive rights of CCTV will not have negative effects on Chinese sports broadcasting market at the Moment.For long-term development considerations,the legislature shall consider future regulations on it.
