The Research On The Leniency Policy Of Pleading Guilty And Accepting Punishment

This article has carried on the theoretical research and the practical investigation to the leniency system in our country's pilot's acceptance of guilt.At the level of theoretical research,through the sorting out of the policy documents and the interpretation of the provisions of the "Pilot Measures",the structure of the system of pleading guilty and punishing leniency is clarified and thoroughly analyzed.In the aspect of practical investigation,this paper,in the form of interviews,the criminal litigation involved in the investigation,prosecution and trial of all aspects of the business staff to conduct interviews,and access to a lot of theory through judicial interviews did not discuss the judicial practice.In a word,the system of recognizing guilt and admitting guilt from punishment is a collection of rules and policies in the criminal legal framework of our country.In practice,there are differences in the operation of plea bargaining from the lenient system in all the pilot areas in our country.Such difference is caused by macroeconomic factors such as the level of judicial civilization and the judicial environment.Specifically,the current guilty of recognizing punishments from a wide range of practice,the construction of the duty lawyer system is still flawed,the handling process of the three agencies still continues the inertia of the traditional criminal case management mode.These issues are still to be further resolved.It can be foreseen that from the current guilty of pleading guilty of penalty as a pilot into the public field of vision,to its reconstruction and officially become the main solution to criminal cases in China,which contains a historic law of development is the rule of law civilization,social civilization,science and technology,Social development to a certain extent,the inevitable result.
