Research On The Consensus Procedure Of Criminal Procedure

Inside the consensus procedure of criminal procedure,there is compromising procedure,summary procedure,quick procedure and confession procedure,the similarity of above is the meeting of minds between parties,or between one party with official administration.Consensus procedure means pursuing the efficiency on the foundation of protecting the minimum justice,and it's the amendment of traditional procedure which neglect the minds of parties themselves.With the four different procedures pushing the justice forward,the defect of one procedure contributes to chaos in judicial practice at the same time.When we re-construct the system of consensus of criminal procedure,we should focus on the different lines,one is to promote the different procedures one by one,another is the connection of them,focusing the similarities of different procedures,the integrating the consensus procedure under the principle of ‘absorbing the similarity,using the difference for complementation,protecting consensus from alienation,being clear with the expenditure of procedure-using,taking other proper measures,promoting the rational use of consensus procedure.
