The whole animation of video games is different from the user interface of video games,the live animation of video games and the general computer software interface.This paper argues that even if there is no rich story background and complex plot settings,the whole animation of video games can be classified as audiovisual works protected by copyright.Although the interactive operation is the essential characteristic of the game different from the audiovisual works,it does not affect the categories of works on the whole fixed animation of video games.The user's operation on video games is neither the original creation nor deductive creation nor performance.It is corresponded to copyright law and feasible to classify the whole animation of video games into audiovisual works,because the whole animation of video games conforms to the statutory components of audiovisual works such as the originality and fixation,and both of them have the expression of diversity and indivisibility,moreover,the production process of the two also tends to be the same.In addition,the categorization of works on the whole animation of video games possesses some value and function in legal sense,for instance,exemplary guidance,standardizing function,benefit distribution.Finally,the categorization of works on the whole animation of video games provides more complete protection for video games and the copyright owner by realizing the infringement identification from the whole and protecting the concrete expression of the game rules,so as to promote the benign development of the industry and the market.
