Political Participation Of The Republic Of China Lawyers

With the advancement of modern judicial reform,the lawyers group of the Republic of China came into being.This new occupational group,while engaged in the profession of lawyers,also participated in politics extensively.lawyers were active in the recovery of the "extraterritoriality" campaign and the anti-Japanese patriotic movement.They advocated human rights guarantee and struggled with corrupt political environment in order to advance the constitutional democratic process of the country.In the area of judicial reform,they insisted on judicial openness and judicial independence,actively launched the movement of unjust verdict compensation,and participated in the promotion of legal aid.The political,legal system and social development during the Republic of China provided guarantee for the political participation of the lawyers.The promotion of democratic constitutionalism construction created a political environment for the development of the lawyers group.In legislation,the guarantee for lawyers' rights became more mature,giving the lawyers union the right to self-governance.The legal experience and social status of the lawyers group also became a powerful driving power for their political participation.During the Republic of China,the development of the lawyers group also encountered great obstacles.The judicial participation and the military power interfering in judicial affairs led to the failure of constitutional construction and judicial reform,coupled with the negative effects of the traditional concept of Legal pettifogger and the turbulent social environment,making the road of lawyers group's political participation rugged.The imperfect grassroots justice has disrupted the normal litigation process.Therefore the lawyers group was unable to go deep into the grassroots level.At the same time,the law stipulated that lawyers had to fulfill their obligations negatively and restricted the lawyers' active participation in litigation activities,making it impossible for modern society to establish true lawyers system.
