Aesthetic Of Appearance Design With Perspective On Patent Law

Laws or legal precedents of most countries have confirmed that the aesthetic of appearance design is necessarily required,for the two properties of industrial-design products: one is natural attributes;another is the intellectual attributes That's why the aesthetic becomes essential to protect the product-appearance design.The third chapter of this article analyzes criteria and protection scope of design patent,and problems with aesthetic feeling are discussed in a specific research method in the fourth chapter.In the fourth chapter we analyze the case abroad and its reference for China,show the measure of aesthetic standards,the differences between design,copyright and invention work.The last chapter offers a proposal that China is also need creativity in design-patent authorization,with a new design with products of creative labor protection period.Our effort is to strengthen the industrial design protection,encourage enterprises to attach importance to innovation.Patent protection is highly required for the development of social modernization.
