The Research On The Mode Of Collaborative Management Of Doctor-patient Disputes

In the past ten years,the contradiction between doctors and patients in our country has become more and more acute.The disputes between doctors and patients have occurred frequently throughout the country,among which there are many cases of violent injuries of extremely bad nature.Not only in China,countries around the world are constantly looking for an ideal mode to mediate disputes between doctors and patients.At present,the research on doctor-patient disputes in China is mainly on medical and health policies and laws and regulations,civil and commercial law,administrative law and local legal system,procedural law and judicial system.It can be seen that the study of doctor-patient disputes is relatively mature in the relevant majors of administration and law,and it is also the mainstream direction of current research.However,these studies basically do not have any innovative perspective in terms of content.Most of them analyze the causes of doctor-patient disputes from the perspective of both doctors and patients,propose governance plans from the perspective of the government,and prefer theoretical analysis.The research perspective is too single.In order to put forward some research ideas from the perspective of practice,this paper uses literature research methods,comparative research methods,case analysis methods,questionnaire survey methods and other research methods,with "collaborative governance" as the starting point,the government departments,social organizations,business organizations,etc.The main body is linked to form a social co-governance model that seamlessly cooperates among multiple entities.On this basis,five model suggestions are proposed: First,optimize the allocation of medical resources under the model of “government + public hospital + private hospital” Second,under the "government + hospital + media",create a new situation of medical knowledge science;third,under the "government + social organization + financial department" model,establish a social risk sharing mechanism,including the establishment of medical accident damage social relief funds and Establish a social medical risk insurance fund system and improve the social medical security system;Fourth,promote the medical accident compulsory liability insurance under the “government + insurance supervision department + insurance company” mode;fifth,in the “government + administrative department + medical supervision committee” In the mode,the third-party mediation of medical disputes is set as the pre-procedure.It is hoped that the unique advantages of different subjects can be brought into full play by means of "collaborative governance" so as to effectively promote the prevention and mediation of doctor-patient disputes in the future.
